Ordering & Payments

Buyers must not put additional terms and conditions into an order, which have not been previously approved in writing by North Bay Trading Co. Additional terms or conditions which are placed into a transactional document, which purport to order a good or product, will not be recognized or honored. If additional terms and conditions are desired, the buyer must negotiate the terms and conditions prior to the order. Additional terms and conditions, if accepted, may increase the price of the goods or products. Unless expressly accepted in writing by North Bay prior to an order, additional terms and conditions placed into an order will not be recognized by North Bay Trading Co. and will not become part of the contract for the sale, even if North Bay does not provide the buyer with a written objection to the additional terms and conditions in the order. In other words, buyers must not put additional terms and conditions into an order, which have not been previously approved in writing by North Bay Trading Co.

To place an order with us, please do one of the following: (1) Shop online and check out by selecting purchase order if you have established payment terms with us, (2) Shop online and check out using credit card, (2) Shop online and check out with your PayPal account, (3) Shop online and mail us your order by selecting check/money order in check out, or (4) Place a phone order by calling us at 1-800-348-0164. Also, you may call for instructions on sending payment via wire transfer.

Purchase orders are transmitted upon completion of check out. An invoice will be included with your shipment. This is for business customers with pre-approved payment terms, typically 30 days.

Terms for International Customers: Our representation is that we cannot provide any statements or certifications that our products meet legal regulations, including import and food regulations, of other jurisdictions. Our products may be legally sold in the United States. We will cooperate with buyer's attempts to obtain necessary export/import licenses by providing necessary information and will cooperate with obtaining other documentation as necessary at buyer's cost. Unless specifically arranged, it is agreed delivery shall be 'ex works' and we will not be responsible for any lost, stolen or damaged goods after the goods are delivered to your designated agent in the United States. Buyer's Representations: Buyer will pay for their order total in US dollars. Buyer or Buyer's agent will accept delivery of the goods at the time they are delivered to the locations selected by Buyer. Buyer agrees that licensing responsibility for determining the proper export authorization and obtaining an export license or authorization is hereby assigned to Buyer and Buyer's forwarding agent in the United States, and that Buyer has the authority to assign the responsibility for shipments to the forwarder. Buyer agrees that it is the importer of record and will comply with all laws and regulations of the destination country. Orders shipped outside of the United States may be subject to import taxes, import licenses, customs duties and fees levied by the destination country. Additional charges for customs clearance must be paid by Buyer. Buyer is responsible for complying with local tax law, such as sales, tariffs and VAT taxes. Buyer will cooperate with providing necessary documents, such as invoices or proof of export. All disputes will be governed by the laws of the United States and the State of Wisconsin, and will be venued in Wisconsin.

Pricing & Promotions

Our prices, specials, and promotions are subject to change at any time, unless otherwise stated, quoted, or agreed upon by wholesale trade contract. Sales and promotions on our retail site usually do not apply to wholesale orders. In the unlikely event of a serious pricing issue created by data entry error, we will give you the option to cancel your order or pay the corrected price.

Viewing Orders

We recommend you register before or during check out. Registered customers may click on My Account in the upper right corner of their browser and view their current and past orders.

Updating Account info

Please click on My Account in the upper right corner of your browser and then navigate to Your Account to change your password and other preferences. Also, you may click on Address Book to update your addresses.

Privacy & Security

Whenever you are on a North Bay Trading webpage that asks for personal information, it is a page that uses secure socket layer encryption. You will notice that the lock icon on your browser becomes locked and, in the address bar, the 'http' changes to 'https'. We do not automatically store your credit card information after your order is placed. If a refund or credit is required, we can ask our merchant bank to refund your credit card without re-collecting your card number. Like most shopping web sites, cookies help us track customer trends, such as which pages are most popular, which time of day brings the most traffic, that sort of thing. These files do not contain any personal indentifying information such as your name and address. We may occasionally use your email address to send you our newsletter or notify you of specials and new products. If you do not wish to receive, you may use the opt out link to discontinue emails from us. We may occasionally provide our customer postal mailing list to companies who wish to send postal mail of likely interest to you, such as gourmet food catalogs. Return Policy

Unfortunately, we cannot cancel orders which have already been shipped. If you do not receive your order in a timely fashion and you cannot track your package, we are glad to investigate and resolve. If items arrive damaged or defective, please retain the product and packaging, and contact us within 3 days to arrange replacement. Let us know within 10 days if you did not receive what you ordered and we will immediately return or exchange the item(s) at no expense to you. Please note we cannot accept food returns which are simply not to your liking. We stand by to assist you with any questions to help ensure you have a positive shopping experience.

Allergens

All of our vendors have assured us that their ingredients do not contain the USA major 9 allergens of milk, egg, fish, crustacean shell fish, tree nuts, wheat, peanuts, soybeans and sesame. We do not have any of the major 9 allergens present in our facility and we do not add any of them to our ingredients. We do not test for specific allergen thresholds. Vendor Questionnaire Policy

Please read our About Us page which contains a link to our SQF food safety audit certificate. We succeed in this GFSI food safety audit and maintain good standing with the State of WI and FDA. The SQF audit is one of the most recognized third party verifications of food safety. You may email us and request our full SQF audit report and we'll send it to you. But if your business still requires a long vendor questionnaire, we may decline your business. This is especially true if your questionnaire is designed to cover the same elements covered in our audit report.
